Reported The Forgotten Constraint Dangerous
Amsterdam court bans Grok undress images of people living in the Netherlands
On 26 March 2026, the Amsterdam District Court preliminary-relief judge (voorzieningenrechter) ruled in summary proceedings brought by Stichting Offlimits against X.AI LLC, X Corp., and X Internet Unlimited Company. Offlimits alleged that the Grok chatbot and the X platform made it possible to generate and distribute non-consensual “undress” images of real people and child sexual abuse material. Defendants described safeguards and user-rule bans against non-consensual undress and CSAM generation; the court still found credible doubt that those constraints held in practice, and issued enforceable bans with daily penalties.
The defendants said they also opposed that content, pointed to terms of use, and described technical measures they had taken. (Rechtspraak news; judgment)
The court found that Offlimits had sufficiently shown serious doubt about how effective those measures were. Among other points, Offlimits submitted evidence that on 9 March 2026 — after defendants had categorically denied that current Grok image features allowed non-consensual intimate imagery of real, identifiable people — it could still generate a video from a photo of a real person placing that person in a sexualized context, without the system checking consent. The official court news summary likewise states that shortly before the hearing Offlimits was still able to generate an undress video with Grok. (judgment; Rechtspraak news)
The operative orders include: prohibiting X.AI from generating or distributing sexual image material that undresses people in whole or in part without explicit consent, insofar as those people live in the Netherlands; prohibiting X.AI from producing, distributing, offering, publicly displaying, or possessing in the Netherlands generated material that qualifies as child sexual abuse material under Dutch law; requiring written confirmation of compliance to Offlimits; and prohibiting X and (more broadly) XIUC from offering Grok as part of the X platform while Grok breaches the relevant bans. Periodic penalty payments (dwangsommen) of €100,000 per day (or part thereof), capped at €10 million, attach to non-compliance. The judgment is provisionally enforceable. Case identifiers: C/13/783613 / KG ZA 26-120; ECLI:NL:RBAMS:2026:3106. (judgment; Rechtspraak news)
This is an interim injunction in kort geding, not a full trial on the merits. The geographic and party-specific limits in the orders matter: several prohibitions are scoped to people living in the Netherlands and/or conduct in the Netherlands, and the court’s news note states the ban covers images of people living in the Netherlands and production/distribution of images in the Netherlands.
